A bench comprising Justice Vikram Nath and Justice Sandeep Mehta passed an interim order on Monday regarding the petition filed by Mohammad Deepak. Meanwhile, the Supreme Court has also sought a response from the Uttarakhand government in the matter.

On Monday, the Supreme Court stayed further proceedings in the criminal case registered against Deepak Kumar (Mohammad Deepak), a gym owner from Dehradun. The case stems from an alleged incident of harassment involving a Muslim shopkeeper in January.
A bench comprising Justice Vikram Nath and Justice Sandeep Mehta issued an interim order on Monday in response to Mohammad Deepak’s petition. The Supreme Court has also sought a response from the Uttarakhand government regarding the matter.
Supreme Court’s Order
The Supreme Court also stayed the Uttarakhand High Court’s order that had restrained Deepak from posting videos or messages related to the incident on social media. The bench stated, “The proceedings arising from the FIR in question, as well as the operation and effect of the High Court’s order, shall remain stayed.”
In March of this year, the Uttarakhand High Court had refused to quash the FIR registered against Deepak. Deepak claims that he had arrived to assist the shopkeeper but was subsequently booked in a case himself.
What is the case about?
The matter relates to an incident on January 26, where some Bajrang Dal activists allegedly objected to a Muslim shopkeeper using the word ‘Baba’ in his shop’s name.
Mohammad Deepak states that he arrived at the scene to help the shopkeeper, who was being harassed. A confrontation ensued between him and some Bajrang Dal members, leading to a criminal case being registered against him as well. Deepak subsequently challenged the FIR registered against him in the High Court.
What did the High Court decide?
In March, the High Court refused to quash the case and permitted the police investigation to continue. The High Court also restrained Deepak from commenting on social media about events related to the case, citing concerns that such comments could hinder the ongoing police investigation. Deepak later approached the Supreme Court.
