Mumbai Police has issued a notice to Imran Khan—nephew of film actor Aamir Khan—directing him to leave India by October 28. Imran Khan had taken part in a protest at Mumbai’s August Kranti Maidan, where demonstrators demanded the resignation of Chief Election Commissioner (CEC) Gyanesh Kumar. He was also taken into custody by the Mumbai Police at the time. Action has now been initiated against him under Sections 7 and 29 of the Immigration and Foreigners Act, bringing the matter back into the spotlight.

A penalty for participating in a protest against Gyanesh Kumar?

This action follows his participation in a protest at Mumbai’s August Kranti Maidan, which called for the resignation of Chief Election Commissioner (CEC) Gyanesh Kumar. He had been detained by the police during the demonstration. Now, with this new action taken under the Immigration Act, the case has once again become a subject of discussion.

What is the case about?

On October 10, a protest was held at Mumbai’s August Kranti Maidan demanding the resignation of Chief Election Commissioner Gyanesh Kumar. The demonstration was held in support of a movement initiated in Delhi by the ‘Cockroach Janata Party’ (CJP). The protesters were demanding the CEC’s resignation over a controversy linked to the ‘Special Intensive Revision’ (SIR) process. Imran Khan was among those who participated in this protest.

During the demonstration, the Mumbai Police took a large number of individuals, including Imran Khan, into custody. Security was heightened in and around August Kranti Maidan, and barricades were set up to contain the protesters. During this period, videos of Imran being taken away in a police vehicle surfaced and went viral on social media. The actor was, however, released shortly thereafter.

Subsequently, the Mumbai Police registered an FIR against Imran Khan and others in connection with the protest. The matter has now returned to the headlines following the issuance of a notice to the actor, directing him to leave India by October 28. This police action stems from the fact that Imran is not an Indian citizen, yet he participated in a political protest while residing in India.

Opposition from a Bharatiya Janata Party (BJP) leader

Kirit Somaiya, a leader from the Bharatiya Janata Party (BJP), had also demanded action against Imran Khan regarding this incident. In a letter to the Mumbai Police, he questioned whether a foreign national is permitted to participate in political protests in India. Somaiya further demanded that the actor be sent out of the country. According to him, since Imran is a foreign national, his participation in the protest warrants an investigation.

Will Imran leave India?

The issue of an ‘Overseas Citizen of India’ (OCI) card has also come up in the context of Imran Khan’s case. It should be noted that an OCI card allows foreign nationals of Indian origin to reside in India and avail themselves of various facilities; however, it does not constitute full Indian citizenship.

Currently, it has been reported that Imran Khan has been served a notice to leave India by October 28, and he has acknowledged receipt of the document. All eyes are now on how Imran Khan responds to this notice and what further steps the police may take.
