While hearing the case on November 25, the High Court had directed the investigating officer to file an affidavit till the next hearing. In this affidavit, he had to clearly state that a case has been registered against Mohammad Zubair under certain sections. Responding in court, the investigating officers said that two new sections have been added in the FIR. 152 of the Indian Penal Code (BNS) and another section 66.

Significantly, an FIR was initially registered against Mohammad Zubair under several sections of the Indian Penal Code. These sections include Section 196 (promoting enmity between different groups on the basis of religion), Section 228 (gathering false evidence), Section 299 (willful and malicious act with intent to hurt religious sentiments), Section 356(3) (defamation) and Section 351(2) (punishment for criminal intimidation).
Mohammad Zubair reached the High Court
Now in this case Mohammad Zubair has reached the High Court seeking cancellation of the FIR and protection. He said in his petition that he did not call for violence against Yeti Narasimhanand on his social media. He had only alerted the police officers about his antics and the video was going viral earlier. Zubair further said that the demand for action by sharing a publicly available video is not defamation.
