Amid criticism from opposition parties in India against the Citizenship Amendment Act (CAA), the US and the United Nations have also expressed concern over it. The United Nations has described the CAA as “discriminatory”. A spokesperson for the Office of the UN High Commissioner for Human Rights told Reuters that the CAA is “fundamentally discriminatory”. “As we also said in 2019, we are concerned that India’s CAA is fundamentally discriminatory and violates India’s international human rights obligations,” he said.
The spokesperson also said that his office is still trying to find out whether the CAA rules are compatible with international human rights law or not. Besides, the American government has also expressed concern about this law.
Fear of return of NRC
“We are concerned about the March 11 CAA notification. We are closely monitoring how this law will be implemented,” a US State Department spokesperson told Reuters over email. The spokesperson also said, “Respecting religious freedom and treating all communities equally under the law are fundamental democratic principles.”
Activists and human rights lawyers say this law, combined with the proposed NRC, could discriminate against India’s Muslims. However, the Government of India has not said anything about implementing NRC at this time. Some people are concerned that the government could revoke the citizenship of Muslims living without papers in some border states.
The law was passed in 2019 itself, but at that time there were so many protests against it in many corners of the country that the government did not implement it. Now once again protests are starting against this law. Opposition parties and many NGOs in Assam are opposing this.

All Assam Students Union (AASU) has announced to hold Satyagraha against CAA in the entire state. According to media reports, students’ organization Mizo Jiralai Paul in Mizoram is also opposing the CAA. The organization burnt copies of the rules of law on Tuesday.
Meanwhile, several petitions have been filed in the Supreme Court to ban CAA. Many such petitions are pending in the Supreme Court for the last several years. According to Tribune newspaper, currently more than 230 such petitions are pending in the Supreme Court.
These petitions were filed after December 2019. In January 2020, the court had refused to stay the CAA and NPR and had said that ultimately a bench of five judges can give its decision in this matter.
