SC announces verdict on electoral bonds scheme: What is it and how is it connected with poll funding?

The Supreme Court has given a big blow to the Modi government in the election year. The court has immediately put a stay on the electoral bond scheme of the central government. The court has declared the electoral bond scheme unconstitutional.

On petitions challenging the legal validity of the central government’s electoral bond scheme, CJI DY Chandrachud said there are two separate judgments – one written by him and the other by Justice Sanjiv Khanna and both the judgments are unanimous.

Advocate Prashant Bhushan said, “The Supreme Court has struck down the Electoral Bond Scheme and has also rejected all the provisions made to implement it. The Court has held that it violates the fundamental right of citizens to get information.” So that they can know who are giving money to political parties. The Court has also struck down the unlimited contributions being made by companies to political parties.”

What did the court say in its decision?

  • Citizens have the right to know where the government’s money comes from and where it goes.
  • The public has the right to know about the donations received by political parties.
  • Electoral bonds are a violation of the Right to Information.
  • The anonymous electoral bond scheme is a violation of the Right to Information under Article 19(1)(a).
  • Violation of Right to Information is not appropriate to curb black money.
  • SBI will have to provide information about electoral bonds.
  • SBI will have to provide information from 2019 till now.
