दिल्ली हाई कोर्ट से TMC नेता महुआ मोइत्रा को झटका, निशिकांत दुबे के खिलाफ दायर याचिका खारिज
Trinamool Congress (TMC) leader Mahua Moitra has received a setback from the Delhi High Court. The court has rejected the petition filed against Mahua BJP MP Nishikant Dubey and lawyer Jai Anant Dehadrai in the case of taking money in exchange for asking questions in Parliament. In this petition, he had sought direction to stop Dubey and Dehadrai from creating, posting, publishing, uploading or distributing any material related to this.
On December 20 last year, the court had reserved its decision on this matter. In her petition, Mahua had sought immediate relief. However, Justice Sachin Dutta has rejected Moitra’s plea seeking interim injunction against Nishikant Dubey and Dehadrai in the defamation suit. When Mahua’s petition was rejected, lawyer Dehadrai said, “I am not particularly excited about it, but I think it was the right thing.”
In fact, after allegations related to taking bribe and asking questions in Parliament came to light, Mahua had filed a defamation case against Dubey and Dehadrai in the High Court. In this he had demanded that Dehadrai and Dubey be stopped from making allegations against him. He had also added the names of media organizations and social media to the petition, which were later removed. Dubey and Dehadrai’s lawyers presented evidence against Mahua before the court.
The lawyers of Dubey and lawyer Jai Anant Dehadrai had cited the investigation report of the Ethics Committee in the court and said that he has been found guilty in the investigation. After this the court had ordered to present the report of the committee. On the other hand, Mahua’s lawyer had argued that Mahua had taken gifts from businessman Darshan Hiranandani as a friend, and not to ask questions against the Adani Group.
Dubey is a Lok Sabha MP of BJP. He is the MP from Godda constituency in Jharkhand. He had won from this seat in the years 2009, 2014 and 2019. On the other hand, Mahua had described Dehadrai as a close friend in one of her posts. He did his clerkship under former Chief Justice Sharad A Bobde. He has worked as legal advisor to Sameer Jain, Vice Chairman of ‘Times of India’ Group.
Mahua is accused of taking bribe from businessman Hiranandani to ask questions related to Adani Group in Parliament. In this regard, Mahua had admitted to giving his Lok Sabha ID-password to Hiranandani, but rejected the allegations of taking bribe. The matter was investigated by the Ethics Committee, which in its report found the allegations to be true and recommended Mahua’s expulsion. On this basis Mahua was expelled from the Lok Sabha.
