Chandigarh mayor polls: Supreme Court raps presiding officer, says won’t allow ‘democracy to be murdered’

The case of Chandigarh Mayor election was heard by three judges led by Chief Justice DY Chandrachud. The Chief Justice also watched the video of the Presiding Office in which he is allegedly canceling the votes. CJI said that this is a mockery of democracy. We are just shocked by what happened.

Chandigarh: Despite having the maximum number of councilors, the Congress-AAP alliance lost the election for the post of Chandigarh Mayor. Here BJP won the election by getting only 16 votes, while the alliance which got 20 votes was declared defeated. The returning officer had rejected eight votes of the Congress-AAP alliance. Regarding this rigging in the Mayor elections, the Supreme Court has commented in a harsh tone and said that we will not allow the murder of democracy.

The Supreme Court on Monday strongly reprimanded election officer Anil Masih. CJI DY Chandrachud said that it is clear that he (election officer) defaced (spoiled) the ballot papers. Is this how they conduct elections? This is a mockery of democracy. This is murder of democracy. We will not allow democracy to be murdered. This officer should be prosecuted.

The Supreme Court ordered that the entire record of the Mayor election be confiscated and kept with the Registrar General of the Punjab and Haryana High Court. Ballot paper and videography should be kept safely. Along with this, the court directed that the upcoming meeting of Chandigarh Corporation will remain postponed.

The Supreme Court said that our conscience will have to be satisfied, otherwise fresh elections will have to be held. The Supreme Court has asked the election officer of mayor elections, Anil Masih, to be present in the hearing on February 19. Election officials should answer to the Supreme Court on their actions seen in the video. Kuldeep Kumar, joint candidate of INDIA i.e. AAP-Congress, has filed this petition. In this, he has demanded the removal of BJP’s newly elected Mayor Manoj Sonkar and re-election.
