Central govt’s decision on Article 370 remains intact, SC said – Assembly elections should be held by September 2024

The Chief Justice has suggested the Central Government to hold elections soon. The court said that elections cannot be kept on hold for long. The Election Commission has been instructed to conduct elections by September 2024.

The Supreme Court is giving its verdict on the petitions challenging the legality of abrogation of Article 370 from Jammu and Kashmir. The court has considered the removal of Article 370 from Jammu and Kashmir right. The court said that Jammu and Kashmir is an integral part of India. The Chief Justice has suggested the Central Government to hold elections soon. The court said that elections cannot be kept on hold for long.

Along with this, a bench of five judges of the Supreme Court asked the Central Government to again give statehood to Jammu and Kashmir. The Chief Justice has asked not to delay it.

The CJI said, the power of the President to give notification of abrogation of Article 370 continues even after the dissolution of the Constituent Assembly of Jammu and Kashmir. The right to remove the provisions of Article 370 is for the integration of Jammu and Kashmir. The President’s order to abrogate Article 370 is constitutionally valid. While delivering the verdict, the CJI said, Article 370 was a temporary provision. Jammu Kashmir is an integral part of India. Jammu and Kashmir had no internal sovereignty.

The CJI said that it is no longer relevant whether the announcement of abrogation of Article 370 was valid or not. The CJI declined to rule on the validity of President’s rule imposed in Jammu and Kashmir in December 2018, as it was not specifically challenged by the petitioners. The CJI said, when President’s rule is imposed, there are limitations on the powers of the Union in the states. Under its proclamation, every decision taken by the Center on behalf of the state cannot be subject to legal challenge. This can spread anarchy.
