While upholding the conviction of Ariz Khan in the 2008 Batla House encounter case, the Delhi High Court on Thursday commuted the death sentence given to him by the lower court to life imprisonment. On August 18, the court had reserved its verdict on confirmation of death sentence to Ariz Khan in the case in which two suspected Indian Mujahideen terrorists and police inspector Mohan Chand Sharma were killed in Jamia Nagar.
The bench of Justice Siddharth Mridul and Justice Amit Sharma of the High Court, giving relief to Ariz Khan, converted his death sentence to life imprisonment. Copy of detailed order is awaited. The High Court had earlier received a reference for confirmation of the death sentence awarded to Ariz Khan.
In fact, in the year 2008, more than 35 people were killed and more than 150 were injured in serial blasts in the capital Delhi. A few days later, the Special Cell of Delhi Police carried out an encounter at Batla House in Jamia Nagar on 19 September 2008. During this encounter, Inspector Mohanchand Sharma was shot dead.
Ariz Khan was convicted of crimes including the murder of Mohanchand Sharma on March 8, 2021, and was sentenced to death on March 15, 2021. Whereas, another convict Shahzad Ahmed was given life imprisonment. The trial court, while convicting Khan, had said that it was duly proved that he and his associates had murdered the police officer. He was sentenced to death and fined Rs 11 lakh, making it clear that Rs 10 lakh should be released immediately to Sharma’s family members.
The court had called the case “rarest of the rare” while awarding death sentence to Ariz Khan, who had fled the scene and was declared a fugitive criminal. He was arrested on February 14, 2018. Police claimed that he was present at Batla House and had managed to dodge the police during the encounter.
